HotelMaven Terms And Conditions

Agreement between Customer and HotelMaven LLC

Welcome to the HotelMaven.com website (the "Website"). This Website is provided solely to assist customers in gathering travel information, determining the availability of travel-related goods and services, making legitimate reservations or otherwise transacting business with travel suppliers, and for no other purposes. The terms "we", "us", "our" and "HotelMaven.com" refer to HotelMaven LLC., an Arizona limited liability company. The term "you" refers to the customer visiting the Website and/or booking a reservation through us on this Website, or through our customer service agents.

Booking with us is offered to you conditioned upon your acceptance without modification of all the terms, conditions, and notices set forth below (collectively, the "Agreement"). By accessing or using this Website in any manner, you agree to be bound by the Agreement. Please read the Agreement carefully, as it contains important information about limitations of liability. If you do not accept all of these terms and conditions, please do not use this Website or book through our agents. Be sure to return to this page periodically to review the most current version of the Agreement. We reserve the right at any time, at our sole discretion, to change or otherwise modify the Agreement without prior notice, and your continued access or use of this Website signifies your acceptance of the updated or modified Agreement.

USE TERMS & CONDITIONS

Pre-paid Hotel Reservations

When you make a prepaid booking, you agree to allow us to facilitate the reservation on your behalf with our hotel suppliers, which includes making payment arrangements. You agree that your payment method will be charged for the Total Reservation Price.

The room rate that is visible to you on HotelMaven.com, through our concierge, or our internal booking software is inclusive of the Supplier Room Rate and Our Service Fee. Taxes and Recovery Fees include Tax Recovery Charges, Merchant Fees, and Taxes on Our Service Fees.

Total Reservation Price

The total reservation price that you agree to is a combination of our Supplier Room Rate, Our Service Fee, Tax Recovery Charges, Merchant Fees, and where applicable, Taxes on Our Service Fees.

Supplier Room Rate

This is the pre-negotiated room rate that our suppliers provide to us.

Our Service Fee

Our service fee is the fee that we charge you for facilitating the reservation on your behalf.

Tax Recovery Charges

Taxes recovery charges are a recovery of the estimated taxes that HotelMaven LLC pays to the hotel supplier for your booking. This may include sales and use tax, room tax, occupancy tax, excise tax, value added tax, etc. HotelMaven LLC does not act as co-vendors with our hotel supplier partners. The hotel supplier is responsible for submitting taxes to the proper jurisdiction.

HotelMaven LLC and partners do not collect taxes on your stay. The amount of taxes and recovery charges that we charge you may be different from the actual amount that we pay the hotel supplier. In the event that there is an excess over what is actually paid by the hotel supplier, you agree that we will retain the difference as a service fee. We agree that in the event that there is a shortfall in what the hotel supplier actually pays, that you will owe nothing more than the originally agreed upon amount listed in your Total Reservation Price.

Merchant Fees

Merchant fees are the cost that credit card issuers charge us to process your credit card. These fees vary depending on the credit card issuer and type of card (credit, debit, rewards, etc.)

Taxes on our Service Fees

Some jurisdictions charge additional taxes on our services fees. When that happens, we include the cost of those taxes in the Tax Recovery Charges.

Cancellation and Refund Policy

We do not charge fees for cancellation however if we incur a fee from the property, we will pass that on to you. Each property or supplier determines the cancellation policy which will vary based on your booking. If you request to cancel your reservation during the cancellation period, we will refund your booking back to the original form of payment.

Cancellation Request Outside Cancellation Period

If you request to cancel all or part of your reservation after the cancellation period has passed, we will proceed in accordance with the cancellation terms of your booking. Your refund may be reduced by any fees that we are charged by the property in conjunction with the cancellation. We will contact the supplier on your behalf in order to attempt to minimize the cancellation fees. HotelMaven LLC, its partners, suppliers, and vendors make no guarantee that the supplier or hotel will agree to reduce or eliminate the cancellation fees.

Additional Hotel Fees

Some hotels charge additional fees that are not included in the price that you pay us. These fees include any applicable charges for optional incidentals (such as parking, telephone calls, food, pet fees, or entertainment), regulatory surcharges, hotel service fees, and resort or spa fees. The hotel may charge these fees at check-in or upon check-out. When provided by the supplier, these fees will be listed in your voucher.

Payment

Your method of payment is charged the total cost at the time of purchase. Room availability and prices are not guaranteed until full payment is received.

Supplier Rules and Restrictions

Separate terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select. Please read these terms and conditions carefully. You agree to abide by the terms or conditions of purchase imposed by any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with the supplier's rules and restrictions regarding availability and products, or services.

You understand and agree that any violation of any such supplier's conditions of purchase may result in cancellation of your reservation(s) or purchase, in your being denied access to any hotels, in your forfeiting any monies paid for such reservation(s) or purchase, You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the booking through HotelMaven.

Pricing Errors

The price of the travel services will be as quoted on the website from time to time, except in cases of obvious error. Prices are liable to change at any time, but changes will not affect bookings already accepted. Despite HotelMaven’s best efforts, some of the travel services listed on the website may be incorrectly priced. HotelMaven expressly reserves the right to correct any pricing errors on our website and/or on pending reservations made under an incorrect price.

In such event, if available, we will offer you the opportunity to keep your pending reservation at the correct price or we will cancel your reservation without penalty. HotelMaven is under no obligation to provide travel services to you at an incorrect (lower) price, even after you have been sent confirmation of your booking.

Liability

HotelMaven LLC and affiliates, and their respective suppliers make no representations about the suitability of the information, software, products, and services contained on this HotelMaven.com for any purpose, and the inclusion or offering of any products or services on this website does not constitute any endorsement or recommendation of such products or services by the HotelMaven LLC or affiliates. All such information, software, products, and services are provided "as is" without warranty of any kind. Hotel ratings displayed on this website are intended as only general guidelines, and HotelMaven LLC and affiliates do not guarantee the accuracy of the ratings.

The suppliers providing hotels are independent contractors and not agents or employees of the HotelMaven LLC and are not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom. HotelMaven LLC and affiliates have no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure or other causes beyond their direct control, and they have no responsibility for any additional expense, omissions, delays, re-routing or acts of any government or authority.

In no event shall HotelMaven LLC or affiliates, and/or their respective suppliers be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of, or in any way connected with, your access to, display of or use of this website or with the delay or inability to access, display or use this website (including, but not limited to, your reliance upon opinions appearing on this web site; any computer viruses, information, software, linked sites, products, and services obtained through this website; or otherwise arising out of the access to, display of or use of this website) whether based on a theory of negligence, contract, tort, strict liability, or otherwise, and even if the HotelMaven companies, the HotelMaven affiliates and/or their respective suppliers have been advised of the possibility of such damages.

Indemnification

You agree to defend and indemnify the HotelMaven LLC and affiliates, and/or their respective suppliers and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:

  • your breach of this Agreement or the documents referenced herein;
  • your violation of any law or the rights of a third party; or
  • your use of HotelMaven.com.

MavenRewards Terms and Conditions

HotelMaven Rewards Terms & Conditions

The HotelMaven Rewards program (“Program” or “HotelMaven Rewards or MavenRewards”) is offered to registered users of HotelMaven.com at the sole discretion of HotelMaven, LLC, and is open only to individuals who are eighteen (18) years of age and older and have a valid email address. Participation in the program, including earning and redeeming of "MavenRewards", is subject to these Terms and Conditions. The terms “You” and “Your” throughout these Terms and Conditions refer to any member and any person eligible to participate in the Program, as applicable.

The Program has no predetermined termination date and may continue until such time as HotelMaven decides to terminate the Program. HotelMaven may terminate the Program at any time with or without prior notice to you. 

HotelMaven makes no guarantees, warranties, or representations of any kind concerning the Program. The Program is void where prohibited by applicable federal, state, or local laws or regulations. The Terms and Conditions of this Program are subject to change as may be necessary to comply with such laws or regulations. By participating in the Program, You release HotelMaven and its affiliates and partners from all claims or liability regarding Your participation in the Program, including but not limited to any claims related to the earning and redemption of MavenRewards. HotelMaven suppliers are in no way affiliated with or responsible for HotelMaven Rewards Program administration.

Definitions

Eligible Booking” means any Eligible Hotel booking through HotelMaven.com or made through a HotelMaven concierge that is completed (not cancelled) by the HotelMaven Rewards member.

Eligible Hotel” means any pre-paid, stand-alone hotel booked on HotelMaven.com or made through a HotelMaven concierge.

Member ID” means the e-mail address You use (with Your password) to sign in to HotelMaven.com and is assigned to you upon registration. 

HotelMaven Rewards member” means any person who has registered for the HotelMaven Rewards Program and is eligible to earn and redeem MavenRewards.

MavenRewards” are the base units of measurement in the HotelMaven Rewards program. The value of one (1) MavenRewards is equal to a credit of one (1) US Dollar on a Redeemable Hotel or redeemable through our Affiliate Rewards Partners or as a Cashback Rebate.

Redeemable Hotel” means any pre-paid, stand-alone hotel that shows an "MavenRewards applied” message for that hotel on the search results page on HotelMaven.com or the HotelMaven mobile app.

Rewards Store” is an online store provided by an Affiliate Rewards Partner of HotelMaven which enables HotelMaven Rewards Members to redeem their MavenRewards.

“Affiliate Rewards Partner” is a third party company that HotelMaven has an agreement with to provide management, supervision, or execution of the HotelMaven Rewards Program; or has an agreement to access the Affiliate Reward Partners reward program in order to provide additional ways to redeem MavenRewards for our members.

Concierge” is HotelMaven’s version of customer service dedicated to answering all of your questions regarding our services and programs.

Cashback Rebate” is the conversion of a Member’s MavenRewards to cash and refunded to the member as a Cashback Rebate based on previous spending.

Membership

You must have an account on HotelMaven.com in order to register for HotelMaven Rewards. Registered members of HotelMaven.com are not automatically enrolled into the HotelMaven Rewards Program and will require a separate enrollment. To enroll in the HotelMaven Rewards program, in addition to checking the join box, You must set up an account and enter a password. Upon enrollment, You will be issued an HotelMaven Rewards account that will be linked to Your Member ID.

As an enrolled HotelMaven Rewards member, You will receive regular account servicing updates by email and other email notifications, including marketing emails.

Membership with HotelMaven Rewards is not transferable. You are responsible for regularly checking Your account and must notify HotelMaven of any omissions, incorrect entries, or other discrepancies.

When available, information about your HotelMaven Rewards account can be accessed via  www.HotelMaven.com/rewards  when logged in with Your Member ID. Information includes but is not limited to Your Member ID, MavenRewards balance, and account history (MavenRewards earned and redeemed). 

Earning MavenRewards

You must be enrolled in the HotelMaven Rewards Program prior to completing an Eligible Booking in order to earn MavenRewards for that Eligible Booking. If You enroll in HotelMaven Rewards after completing an Eligible Booking, even if You enroll before travel is completed, You will not earn MavenRewards on that Eligible Booking.

MavenRewards will be awarded only to the account of the HotelMaven Rewards member who made the Eligible Booking; additional individuals named as travelers on the itinerary will not earn MavenRewards. If booking a trip for another individual as a travel arranger, the HotelMaven Rewards Program account linked to the Member ID used to book the travel will earn MavenRewards for the Eligible Booking. 

Eligible Hotels

You will earn a percentage of the amount paid to HotelMaven for Your Eligible Hotel booking. You will not earn MavenRewards on any charges collected directly by the hotel, e.g., Resort fees, room service, room upgrades. The percentage of rewards earned varies by booking and will be listed on your receipt.

After completing an Eligible Booking, the amount of MavenRewards earned for that Eligible Booking (other than any bonus MavenRewards earned pursuant to a then-active promotion) will immediately deposited in your account and listed as pending. The amount that is pending will become available to spend after the Eligible Booking that produced the reward earning is completed. Changes or cancellations to the Eligible Booking may result in changes to the amount of MavenRewards credited/ debited to the HotelMaven Rewards member's account for that itinerary. No MavenRewards will be earned for change or cancellation fees imposed by HotelMaven or its suppliers.

If Your HotelMaven Rewards account does not represent the correct number of MavenRewards that You should have been awarded as determined by HotelMaven, HotelMaven reserves the right to adjust Your MavenRewards balance. If You believe Your HotelMaven Rewards account has been the subject of any suspicious activity, please contact HotelMaven Customer Service immediately at (833) 696-2836. If it is determined You have been the victim of a fraud, the MavenRewards You have earned will be transferred to a new HotelMaven Rewards account.

Promotional MavenRewards

HotelMaven may periodically conduct promotions that offer promotional MavenRewards to HotelMaven Rewards members. The earning, redemption, and expiration dates of promotional MavenRewards earned from HotelMaven Rewards promotions are governed by the terms of each individual promotion. 

Redeeming MavenRewards

MavenRewards earned on a hotel booking may be used towards any Redeemable Hotel booking. If you are unable to access the Website, you can find out if a hotel is eligible by contacting our Concierge at (833) 696-2836.

When booking a Redeemable Hotel, You will have the option to use all Your MavenRewards to pay for part or all of the booking (if Your MavenRewards balance is greater than amount due). If You choose to use Your MavenRewards, we will subtract the amount of the MavenRewards you are redeeming from the total amount due for Your booking. If You choose not to use Your MavenRewards, they will remain in Your account for future use, subject to any expiration. MavenRewards with the earliest expiration date will be redeemed first.

If You make a multiple room booking at a Redeemable Hotel and choose to use Your MavenRewards, Your MavenRewards will be deducted from the total cost of the booking. MavenRewards applied to multiple room bookings cannot be selectively applied to any one room but are applied to the overall total cost of the Redeemable Hotel booking. If You subsequently cancel one or more rooms in the multiple room booking, and if You are entitled to a refund, the amount refunded to You will be the cost of the particular room canceled less the amount of MavenRewards proportionally applied across all rooms. The amount of MavenRewards proportionally applied to the canceled room will be refunded to Your account.

If You choose to redeem MavenRewards, then the MavenRewards are deducted from Your MavenRewards balance immediately. If the Redeemable Hotel at which you are redeeming is also an Eligible Hotel, You will earn MavenRewards on the portion of Your booking not paid for with MavenRewards.

If You cancel a refundable reservation within the cancellation window at a Redeemable Hotel paid in whole or in part by MavenRewards, the MavenRewards used for the Redeemable Hotel booking may be re-issued to Your account with their original expiration date. To the extent You used MavenRewards to pay taxes and/or fees chargeable with respect to such Redeemable Hotel booking, any MavenRewards that are re-issued to Your account are re-issued in the following order of priority: (i) the portion used to pay any and all taxes charged with respect to the Redeemable Hotel booking (if any), (ii) the portion used to pay fees (if any) and (iii) all other costs of the Redeemable Hotel booking. MavenRewards redeemed on a non-refundable reservation at a Redeemable Hotel will be re-issued to your account after any fees due to the Supplier are subtracted.

Cancelling a non-refundable booking may result in the loss of all MavenRewards applied to that booking. MavenRewards cannot be used to pay or offset any cancellation fee that did not already have MavenRewards applied. All bookings and cancellations are governed by the HotelMaven Terms and Conditions and any separate hotel policies that may apply. 

MavenRewards may not be assigned, sold, transferred, and/or pledged to any third party or to another account without the express permission of HotelMaven LLC. You have no property rights or other legal interests in MavenRewards. You are responsible for any personal tax liability that may be related to participation in the HotelMaven Rewards Program and redemption of any MavenRewards.

Affiliate Rewards Partnerships

HotelMaven LLC may outsource some or all of the management, supervision, and execution of our Rewards program to third parties. You agree to allow us to share all data related to your rewards earning with them in order to service your account. This may include personal information identifiable to you such as your First Name, Last Name, Address, Email, Booking History, Rewards Earning, Rewards Spending, and Rewards Expiration dates. You agree that if you redeem or transfer your MavenRewards with one of our Affiliate Rewards Partners that you are responsible for any personal tax liability that may be related to participation in the HotelMaven Rewards Program and redemption of any MavenRewards with our Affiliate Rewards Partners.

Expiration of MavenRewards

Non-Promotional MavenRewards

Except as otherwise provided in these HotelMaven Rewards Terms and Conditions, all non-promotional MavenRewards earned through the purchase of Eligible Bookings expire at 11:59 p.m. Arizona time on the 365th day after they were earned. Once MavenRewards have expired, they cannot be reinstated under any circumstances.

Promotional MavenRewards

HotelMaven Rewards may periodically conduct promotions that offer MavenRewards to HotelMaven Rewards members. MavenRewards earned from HotelMaven Rewards promotions expire according to the terms and conditions of the applicable promotion, and may not be refundable if You cancel a Redeemable Hotel reservation to which the promotional MavenRewards were applied. MavenRewards earned through promotional activities are equal in dollar value to MavenRewards earned through Eligible Bookings. Promotional MavenRewards will be credited/ debited to Your account in accordance with their terms & conditions upon completion of the promotional activity. 

 

Taxability of Rewards Benefit

Each Member tax situation is different. As such, HotelMaven does not claim to know the taxability of MavenRewards benefits, free nights, or cashback rebate as it pertains to your personal tax country, state, county, or situation. Member agrees to release HotelMaven LLC from any liability regarding unpaid personal taxes of the member as it pertains to HotelMaven Rewards. HotelMaven LLC agrees to release member from any unpaid tax liability regarding business federal, state, city, or taxes in conjunction with MavenRewards.

Changes to HotelMaven Rewards Terms & Conditions

HotelMaven may change or cancel the Program rules, Program benefits, and these Terms and Conditions at any time without prior notice. These changes may affect the value of MavenRewards already earned. HotelMaven reserves the right to terminate the Program, or any part thereof, in any jurisdiction, at any time, with or without notice, even though such termination may affect the right to earn MavenRewards or redeem MavenRewards, or the value of previously earned MavenRewards. HotelMaven is not liable to HotelMaven Rewards members in any way for any value or benefits HotelMaven Rewards members may lose as a result of any changes made to the Program.

In the event a change to the terms affects the valuation of the previously earned rewards, We will notify members 30 days prior to the change so that they may have a chance to redeem rewards under the previously agreed terms. This notification may be by email. HotelMaven is not responsible for the non-delivery of the notification email due to an invalid email address on file or a spam filter on the member’s email. It is the responsibility of HotelMaven Rewards members to check the HotelMaven.com website regularly for any changes to the Terms and Conditions of the HotelMaven Rewards Program or by contacting the Concierge at (833) 696-2836. Continued membership in the Program will be deemed as acceptance of the current HotelMaven Rewards Terms and Conditions. Any previous versions of the HotelMaven Rewards Terms & Conditions are null and void. 

Fraudulent Activity

HotelMaven has the right to monitor all HotelMaven Rewards members’ account activity. If Your HotelMaven Rewards account shows signs of fraud, abuse, or suspicious activity, HotelMaven may, in its sole discretion, close or freeze Your HotelMaven Rewards account immediately, and You may lose some or all of Your earned MavenRewards, including any MavenRewards earned through fraudulent bookings. Examples of fraud, abuse, or suspicious activity include but are not limited to breaching these Terms and Conditions; engaging in any illegal or fraudulent conduct or activities with respect to the earning or redeeming of MavenRewards; supplying or attempting to supply false or misleading information to HotelMaven or a travel supplier; making a misrepresentation to HotelMaven or a travel supplier; selling, assigning, transferring, or acquiring, or offering to sell, assign, transfer, or acquire, any MavenRewards; To contest freezing of an account or the cancellation of MavenRewards, please call the Concierge at (833) 696-2836. 

If You have conducted any fraudulent activity, HotelMaven reserves the right to take any necessary legal action. In addition, You may be liable for monetary losses to HotelMaven, including litigation costs and damages, and You will not be allowed to participate in the HotelMaven Rewards Program in the future.

Disputes and Other Terms

HotelMaven is committed to customer satisfaction, so if you have a problem or dispute, we will try to resolve your concerns. But if we are unsuccessful, you may pursue claims as explained in this section.

You agree to give us an opportunity to resolve any disputes or claims relating in any way to the Services, any dealings with our customer service agents, any services or products provided, any representations made by us, or our Privacy Policy (“Claims”) by contacting HotelMaven Legal: Arbitration Claim Manager,” at 3610 South Tower Avenue, Chandler, AZ 85286. If we are not able to resolve your Claims within 60 days, you may seek relief through arbitration or in small claims court, as set forth below.

Any and all Claims will be resolved by binding arbitration, rather than in court, except you may assert Claims on an individual basis in small claims court if they qualify. This includes any Claims you assert against us, our subsidiaries, travel suppliers or any companies offering products or services through us, including Providers, (which are beneficiaries of this arbitration agreement). This also includes any Claims that arose before you accepted these Terms, regardless of whether prior versions of the Terms required arbitration.

There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including statutory damages, attorneys’ fees and costs), and must follow and enforce these Terms as a court would.

Arbitrations will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA Consumer Rules. The AAA's rules are available at www.adr.org or by calling 1-800-778-7879. Payment of all filing, administration and arbitrator fees will be governed by the AAA's rules, except as provided in this section. If your total Claims seek less than $10,000, we will reimburse you for filing fees you pay to the AAA and will pay arbitrator’s fees, unless the arbitrator determines your Claims are frivolous. You may choose to have an arbitration conducted by telephone, based on written submissions, or in person in the state where you live or at another mutually agreed location.

To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your Claims to HotelMaven Legal: Arbitration Claim Manager,” at 3610 South Tower Avenue, Chandler, AZ. If we request arbitration against you, we will give you notice at the email address or street address you have provided. A party requesting arbitration must also provide a copy of the request to the AAA, at Case Filing Services, 1101 Laurel Oak Road, Suite 100, Voorhees, NJ 08043 or online at www.adr.org or at any AAA office.

Any and all proceedings to resolve Claims will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a Claim proceeds in court rather than in arbitration, we each waive any right to a jury trial. The Federal Arbitration Act and federal arbitration law apply to this agreement. An arbitration decision may be confirmed by any court with competent jurisdiction.

Liability

HotelMaven acknowledges that certain laws imply terms, conditions, or warranties into contracts for the supply of products or services that cannot be excluded. Except as provided in any law which cannot lawfully be excluded or modified by agreement, HotelMaven and any of their officers, employees, or agents are not liable for any loss or claim of any kind (including, without limitation, consequential or economic loss or loss of profits) with respect to the breach of any of these HotelMaven Rewards Terms and Conditions by any person, or for any death or injury or consequential loss or damage arising from the supply or redemption of MavenRewards or any other of Your benefits save to the extent that such loss or claim arises from the willful misconduct of HotelMaven or any of their officers, employees or agents.

These Terms & Conditions govern Your participation in the Program. By participating in the Program, You agree to be bound by these Terms & Conditions. All Terms & Conditions of the HotelMaven.com Website are applicable for the Terms & Conditions of the HotelMaven Rewards program. Adhering to these or choosing one over another is solely by the discretion of HotelMaven. 

Rewards FAQ

  1. When do my rewards become available?

    1. For each booking, your rewards become Pending immediately after payment. They move from Pending to Available the day after check-out. Once Available they can be redeemed at any time.

  2. How can I get my rewards balance?

    1. Text 1-833-MYMAVEN with the word “Balance” and your personal identifier.

    2. Contact your Maven concierge.

    3. For transaction history email rewards@hotelmaven.com.

  3. Do my rewards expire?

    1. Unfortunately, yes, the IRS requires that we have an expiration date. All rewards earned will expire at the end of the day (PST) on December 31st of the year following the year they are earned year. Rewards are redeemed on a first-in first-out basis. For example, all rewards earned in 2019 that are unused will expire at the end of the day (PST) on 12/31/2020.
